These Terms and Conditions are intended to provide information on the use of the website https://electrocharge.bg, as well as on Electrocharge's services related to the possibility of charging electric vehicles at charging stations of ELECTROCHOLD IPC Ltd (hereinafter referred to as "charging stations"/"the charging stations"). These General Terms and Conditions define the rules for the use of the Site and the relationship between ELECTROCOHOLD IPC Ltd, on the one hand, hereinafter referred to as the "Operator", and the Users of the Site, on the other hand.
DEFINITIONS
In the application and interpretation of these Terms and Conditions, the following terms and expressions shall have the following meanings:
“ 'Electric vehicle (EV)' means a powered motor vehicle including at least one non-peripheral electrical device as an energy converter with a rechargeable electrical energy storage system that can be charged by an external source.
"Charging Station" means a complete assembled technical product included in the network of charging stations administered by Electrocharge, which provide the necessary power and energy to charge the batteries in electric vehicles.

"Malicious Acts" are acts or omissions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending junk mail (unsolicited commercial messages, SPAM, JUNK MAIL), overfilling channels (FLOOD), gaining access to resources with foreign rights and passwords, exploiting flaws in systems for their own gain or to obtain information (HACK), performing acts that may qualify as industrial espionage or sabotage, damaging or destroying systems or data sets (CRACK), sending "Trojan horses" or causing the installation of viruses or remote control systems, interfering with the normal operation of other users of the Internet and associated networks, committing any acts that may qualify as a criminal offence or administrative offence under Bulgarian legislation or other applicable law, as well as acts that may be intentionally caused to the site and that lead to the inability of their normal functioning and/or their intentional damage or destruction.
"Operator" of the services provided by "Electrocharge" is "ELECTROHOLD IPC" Ltd., registered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency, with UIC: 207104361.
"User" means any individual who has visited and/or uses the official Electrocharge website located at: https://electrocharge.bg.
"A "website" is a distinct location on the Internet that is accessible via its Uniform Resource Locator (URL), HTTP, HTTPS or other standardized "protocol" address and contains files, programs, text, sound, picture, image or other materials and resources. For the purposes of these Terms and Conditions, official website/site means: https://electrocharge.bg.
"Services" within the meaning of these Terms and Conditions may be the following non-exhaustive terms:
- Services provided by the "Electrocharge" brand, the "Electrocharge" mobile app or the https://electrocharge.bg website;
- type, technical parameters, manner of use of the charging stations of "Electrochold IPC" Ltd, branded with distinctive signs of the Operator or otherwise, concerning the services provided by "Electrocharge".
1. Subject of services provided by "Electrocharge"
1.1. The services provided by "Electrocharge" represent the possibility of charging electric vehicles at charging stations branded with the distinctive signs and symbols of the Operator.
1.2. Details about the network of charging stations, information about the technical parameters and charging capabilities of the charging stations of the Operator are available on the official website: https://electrocharge.bg, as well as in the mobile application "Electrocharge".
1.3. (1) The charging of EVs at the Operator's charging stations is possible after downloading the Operator's mobile application from the "App Store" (for iOS) or "Google Play" (for Android) on the User's mobile device and complying with the conditions specified in the application. The Operator's website is for informational purposes only and the service for charging EVs at the Operator's charging stations cannot be used through it, nor can payments be made at the Operator's charging stations.

(3) In the event of a discrepancy between the information provided on the Operator's official website and that provided on the website(s) of other Operators or the Operator's partners regarding the Electrocharge service, the information provided on the Operator's official website shall be deemed valid.
2. General information about using the site: https://electrocharge.bg
2.1. These Terms and Conditions govern your use of the https://electrocharge.bg
2.2. By opening (visiting/using) the site, the User accepts these Terms and Conditions. In the event that the User does not accept these Terms and Conditions, the User should discontinue using the site.
2.3. No registration is required to visit and use the site and it is free and open access.
2.4. When visiting or using the Site, the User shall ensure that all reasonable security measures, including but not limited to anti-virus programs, are followed when using computer hardware, software or other equipment while accessing the Site and shall be responsible for the consequences that may occur as a result of insufficient security of the device that the User uses to access the Site.
3. “ Use of the services provided by "Electrocharge"
3.1. The use of the services provided by "Electrocharge" is carried out through the mobile application "Electrocharge", which can be downloaded from the "App Store" (for iOS) or "Google Play" (for Android) on the User's mobile device. For convenience, the User can also use a QR code, which is located at each charging station of the Operator. The QR code automatically redirects to the "App Store" or "Google Play" from where the application can be downloaded to the User's mobile device. The "Electrocharge" app can only be used and is only compatible with charging stations that carry the Operator's branded signage. The app cannot be used and is not compatible with other Operators' charging stations.
3.2. Instructions for charging EVs at the Operator's charging stations as well as information about the mobile app are available on the website.
3.3. Through the website the User can be informed about the available charging stations of the Operator on the territory of the Republic of Bulgaria, their location and status (whether they are occupied or free).
3.4. The User agrees to use the Operator's official website in accordance with all applicable laws and regulations.
4. Fees and payments when using the services provided by "Electrocharge"
(2) Detailed information on prices and charges for charging and downtime of EVs at charging stations branded with the Operator's distinctive signs and symbols, including the minimum value of charged energy at the Operator's charging stations, are provided in the "Electrocharge" mobile application.
(3) The prices and fees for charging at the Operator's charging stations are quoted in Bulgarian leva including VAT. In the event that the common European currency - Euro - is adopted in the Republic of Bulgaria during the term of these General Terms and Conditions, the prices and charges will automatically be displayed in Euro.
4.2.. Information on promotional conditions for charging EVs at the Operator's charging stations is available on the website, and any User can inform themselves free of charge.
4.3. There are no fees for using or visiting the site.
5. Rights and responsibilities of the parties
5.1. (1) The User is obliged to inform himself about these General Terms and Conditions and the Privacy Policy available on the official website: https://electrocharge.bg. In case the User does not agree with these General Terms and Conditions or the Privacy Policy, the User should stop visiting and using the Operator's website.
(2) In the event that the User continues to use / visit the website https://electrocharge.bg, it is deemed that the User is aware of and agrees to these Terms and Conditions and the Operator's Privacy Policy.
5.2. Any misuse of the Operator's website is prohibited and in the event that such misuse is proven, the User shall be liable for damages and/or lost profits.
6. Limitations of liability of the Operator
6.1. (1). The operator aims to provide continuous and uninterrupted access to the site.
(2) Notwithstanding what is stated in par. 1, the Operator shall not be liable in the event that:
6.1.1. the site is temporarily unavailable due to reasons beyond the Operator's control;
6.1.2. The user is not using the site properly.
6.2. The Operator shall not be liable for any material or non-material damage that the User may suffer in connection with the use of the site, as well as for non-compliance with these Terms and Conditions.
6.3. The Operator shall not be liable for any damage or loss caused by any statutory provision, act of government, war, sabotage, failure or delay in delivery, information links or other data and communication links, strike, boycott or other similar circumstances beyond the Operator's control. The provision regarding strikes, boycotts and blockades applies if the Operator is subject to such actions.
7.1. (1) "Electrocharge IPC Ltd. is a personal data controller and as such processes the personal data provided to it by Users of the website and the services provided by Electrocharge, in accordance with the provisions of the applicable legislation on the processing and protection of personal data, without being liable for any incorrect data filled in by the User (if necessary), if this has caused or could cause damage to a third party.
(2) The privacy policy of the Operator and detailed information on the processing of personal data of Users of the site and the services provided by Electrocharge is available in the section "Privacy Policy" on the website https://electrocharge.bg.
8. Contact with the Operator
8.1. For questions and reporting problems related to the use of the Site or technical problems in the use of the Operator's charging stations, the User may contact the Operator at: support@electrocharge.bg.
8.2. The Operator and the User are entitled to make written statements and send messages between themselves in connection with these Terms and Conditions. Valid messages and statements shall be deemed to be those made in writing and sent to the e-mail address indicated in point 8.1. and/or sent to the registered office and address of the Company entered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency, with the mandatory specification that it is about the General Terms and Conditions of Use of the Electrocharge website.
9. Applicable law and dispute resolution
9.1. The parties declare that in the event that any provision of these Terms and Conditions is found to be invalid or unenforceable, this shall not invalidate any other provision or the Terms and Conditions as a whole.
9.2. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not covered by these General Terms and Conditions.
9.3. All disputes relating to these General Terms and Conditions, which the parties have not been able to resolve by negotiation and mutual agreement, shall be referred to the competent Bulgarian court in the territory of Sofia.
10. Use of cookies
10.1. (1) „Cookies" or "Cookies" are small text files with information that are stored in an Internet browser or hard drive that the User uses when visiting the site. Cookies allow the https://electrocharge.bg website to be improved to contain the most useful information for the User.
(2) The user can set their internet browser so that it does not save cookies or delete cookies that have already been saved. If the User wishes to take advantage of these features, he/she should use his/her Internet browser settings.
(3) The Operator shall not be liable if the User's Internet browser does not support the functions for controlling the use, refusing to save or deleting saved cookies.
(4) In the event that a User disables the saving of cookies or deletes cookies already saved, the functioning of the site may be disrupted.
(5) The Operator may store cookies on the User's device if they are absolutely necessary for the operation of the website. For all other types of cookies, the User's approval is required. The official website of the Operator uses cookies only to enable or improve certain of its functionalities, to facilitate the navigation process for the User. The Operator does not use cookies to collect, process, distribute or store personal data. Should a User continue to use the Operator's website, the latter agrees to these cookies.
11.1. All content on the https://electrocharge.bg website, including text, graphic design, images icons, photos and software is the property of ELECTROHOLD ICT EAD or the respective right holders who have assigned the right of use to the Operator. Any other use, including copying, scanning, etc. of the materials on the Site without the prior written approval of ELEKTROHOLD ICT EAD is prohibited.
11.2. All intellectual property rights to information resources (including but not limited to trademarks, text, design, images, database, graphics, photos), materials published on the site, the choice and arrangement of files belong to ELECTROHOLD ICT EAD. The information resources are subject to protection under the current Copyright and Related Rights Act, Trademarks and Geographical Indications Act and their implementing regulations. Their unauthorized use constitutes an offence and results in civil, administrative and criminal liability in accordance with the Bulgarian legislation in force.
11.3. The User is aware that the services provided by "Electrocharge" and all rights thereto are the exclusive property of the Operator or its right holders who have assigned the right to use the Operator.
12. Other conditions
12.1. The Operator's website may contain banners (advertising images) or text links to external web pages (websites) for which other parties (advertisers, sponsors, partners, etc.) are responsible.
12.2. (1) Links from the Operator's website to other websites are only a recommendation and a potential source of additional information. As the Operator has no influence over their posting policy, the Operator disclaims any responsibility for the content, uploaded materials, information, photos and information.
(2) The Operator is not responsible and has no obligation to verify the truthfulness, topicality and accuracy of the information, materials, photos, etc. published on other websites and concerning the services provided by Electrocharge.
13. Entry into force and changes to the General Terms and Conditions
13.1. These Terms and Conditions are published on the official website https://electrocharge.bg.
13.2. (1) „ELECTROHOLD IPC Ltd reserves the right to amend these Terms and Conditions at any time without prior notice and/or consent from any User of the Site.
(2) The user is obliged to periodically check the official website www.electrocharge.bg for such possible changes. Amendments shall take effect from the date of their publication on the official website.
(3) In the event that the User continues to use the Site after the date of publication of the amendment to the Terms and Conditions, the User shall be deemed to have read and agreed to the new version of the Terms and Conditions.
These Terms and Conditions are valid and effective from 01.11.2024. These Terms and Conditions are amended as of 01.07. 2025.
