General terms and conditions for using Electrocharge.bg for charging electric vehicles (EVs) at a charging station
The general terms and conditions organize the order and manner of use of the information services, provided by ELECTROHOLD EPC with EIC 207104361, by users on the website: www.electrocharge.bg and regulate the relations between ELECTROHOLD EPC and each of the registered and unregistered users (called hereinafter only "user") of the services available through the website: www.electrocharge.bg.
1. General conditions
1.1. These general terms and conditions govern the use of the electric vehicle charging mobile application provided by ELECTROHOLD EPC.
1.2. By downloading, installing and using the application, the user accepts these terms. In case the user does not accept these general conditions, he/she should stop using the application.
2. Registration and Account
2.1. To use the Application, the User is required to create a User Account by providing valid information, including an email address and password.
2.2. The user is responsible for maintaining the confidentiality of login details and for all activities carried out through his account.
2.3. The user undertakes to protect and not provide to third parties the access information to his user account in the application, as well as the personal data used for registration in the application.
2.4. The user is considered informed that the provision of his personal and registration data to third parties may lead to the unlawful use of the provided data by these persons and/or use of the application in non-compliance with these general conditions, for which "ELECTROHOLD IPS" is not responsible, and that any actions by these third parties will give rise to valid legal consequences that cannot be disputed by the user.
3. Use of the Application
3.1. The application provides information about available charging stations, their location, status and prices.
3.2. Through the app, the user can reserve charging stations, start and stop charging, and make payments.
3.3. The User agrees to use the Application in accordance with all applicable laws and regulations and not to abuse the services provided through the Application.
4. Fees and Payments
4.1. EVS charging prices are listed in the appendix and are subject to change.
4.2. Top-up payments are made through the App using user-provided payment methods, including credit/debit cards and mobile payments.
4.3. The user undertakes to pay all fees related to the use of the charging stations.
5. User Responsibilities
5.1. The user is responsible for the correct connection and use of the charging equipment.
5.2. The user must not leave the EV at the charging station for longer than the required charging time.
5.3. The user must immediately inform ELECTROHOLD EPC of any problems or malfunctions of the charging stations.
5.4. ELECTROHOLD EPC reserves the right to refuse registration in the application or to terminate it when there is evidence of misuse of customer data or the present general terms and conditions for using the service and/or the legislation are not observed.
5.5. Any abuse of the application is prohibited and, provided it is proven to have been committed, the user is responsible for the damages caused.
6. Limitations of Liability
6.1. ELECTROHOLD EPC shall not be liable for any damage to the UPS or equipment occurring during charging, unless caused by intentional acts or gross negligence on the part of ELECTROHOLD IPS.
6.2. ELECTROHOLD EPC does not guarantee the continuous availability of the charging stations and is not responsible for any losses resulting from temporary unavailability.
6.3. ELECTROHOLD EPC is not responsible for property or non-property damages that the user may suffer in connection with the use of the application and the website in case of non-compliance with these general terms and conditions.
6.4. ELECTROHOLD EPC reserves the right to deactivate a user account in cases where the user violates these general conditions for using the application.
7. Personal data
7.1. ELECTROHOLD EPC processes personal data in accordance with applicable data protection legislation. For more information, please read the ELECTROHOLD EPC Personal Data Protection Policy Policy.
8. Changes to Terms
8.1. ELECTROHOLD EPC reserves the right to change these general conditions at any time. The changes will be posted in the application and if the user continues to use the application after the date of publication of the change of these terms, it is considered that he agrees to the new version of the terms and conditions.
